Catherine Chisholm was sitting in the driver’s seat of her vehicle, eating her lunch when suddenly her vehicle was struck from behind. Ms. Chisholm’s vehicle then struck the vehicle parked in front of her and she immediately suffered from slight dizziness and weakness, along with facial pain and swelling.

Edward Jack was visiting his cousin at the Goldcrest Apartments in Gold River, B.C. He was leaning against the balcony when suddenly the balcony railing gave way and caused him to fall three stories to the ground. Mr. Jack’s injuries included a broken pelvis, fractured ribs, fractured vertebrae, and internal injuries resulting in hernias.

Atalyah Gutbir went into labour and was admitted to Toronto General Hospital. Her baby was born in critical condition with a permanently damaged brain. The Defendant was found to have breached the standard of care because the attending nurse did not properly monitor the foetal heart rate of the baby. Due to the breach, the foetal hearbeat abnormalities were not detected, whereas detection could have prevented the injury.
